Yes, You Can — With Their Permission
Adult children buy life insurance on their parents all the time. It is legal. It is common. Insurance companies do this every day. Your parent is the insured person. You are the owner. You pay the bill. You or a sibling can be named to get the payout.
But there is one rule you cannot skip: your parent must consent. They have to know about the policy, agree to it, and sign the application. No consent, no policy.
Why the Law Requires Consent
Here is why the law works this way. A policy pays money when someone dies. It would be risky if anyone could take one out on you in secret. So the law asks for two things:
- Insurable interest. You must have a real financial reason. As a child who would pay for the funeral, this is easy to show. Funeral costs alone count.
- Consent. Your parent must agree in writing and usually answer a few health questions, often in a short phone interview.
Both boxes must be checked. One without the other does not work.
You Cannot Do It Behind Their Back
Be clear on this. You cannot buy a policy on a parent who does not know. Faking a signature is fraud. Hiding the policy is fraud. A fraud policy pays zero. You could face charges too.
If your parent cannot agree — for example, due to dementia — talk to an elder law attorney. Do not try to get around the rules. It is not worth the risk.
What Your Parent Actually Has to Do
Less than most people fear. For a final expense policy, your parent typically needs to:
- Agree to the policy and sign the application (this can often be done by phone or online).
- Answer a short set of health questions — or none at all, for guaranteed issue plans.
There is no medical exam for these plan types. Many parents are relieved to learn it takes about 15 minutes. You can handle the research, the phone calls, and the premium payments — they just need to say yes and sign.
A Kind Way to Bring It Up
The money talk is the hard part, not the paperwork. Try framing it around love, not death: "Mom, I want to make sure I can give you the send-off you deserve without going into debt. Can we spend 15 minutes making sure that is handled?"
Most parents would rather talk now. That beats leaving you with a big funeral bill and a pile of guesswork.
